These General Terms and Conditions of Sale govern the purchase of ZP8 brand products made through the website zp8.it.

By placing an order on the website, the Customer declares to have read and accepted these General Terms and Conditions of Sale.

1. Seller

2. Scope of application

These Conditions apply to purchases made through zp8.it by consumers, i.e. natural persons who purchase for purposes unrelated to their business, commercial, craft, or professional activity.

The Seller reserves the right to modify these Conditions. The version published on the website at the time of purchase will apply to the order.

3. Products

ZP8 offers eyewear products and other products belonging to the brand's universe.

The essential characteristics of each product are indicated on its respective product page.

The images, photographs, and representations of the products are for illustrative purposes only. Colors, shades, textures, and small details may appear different from the actual product, also depending on the device and screen used.

Some ZP8 products are made through production processes and workmanship that may result in minor variations between one item and another.

Such variations, when inherent in the production process and not such as to compromise the functionality or quality of the product, do not constitute a defect.

4. Availability

All orders are subject to product availability.

Should a product exceptionally be unavailable after the order has been placed, ZP8 will promptly inform the Customer and proceed with the refund of any amounts already paid.

5. Prices

Prices indicated on the website are expressed in euros (€) and, where applicable, include VAT.

Any shipping costs are indicated separately before the final confirmation of the order.

For shipments to non-EU countries, any customs duties, local taxes, import charges, or other costs applied by the authorities of the destination country, unless otherwise indicated during checkout, are borne by the recipient.

6. Order completion

To make a purchase, the Customer selects the desired products, adds them to the cart, and completes the checkout procedure by providing the requested information.

Before submitting the order, the Customer can verify the selected products, price, shipping costs, and any other costs.

Submitting the order implies the obligation to pay.

Following receipt of the order, ZP8 will send a confirmation to the email address indicated by the Customer, containing the main information relating to the purchase.

ZP8 reserves the right not to accept or to cancel an order in the presence of evident errors, payment-related issues, suspected fraud, or product unavailability. In such cases, any amounts already paid will be refunded.

7. Payments

Payment can be made using the methods available during checkout.

Transactions may be managed through external payment service providers and are subject to their respective terms of use and security policies.

ZP8 does not directly store full payment card details when payment is handled by external providers.

8. Shipping and delivery

Orders are shipped to the address indicated by the Customer during checkout via DHL Express.

Available shipping costs and methods are displayed before the order is finalized.

Any times indicated on the website are estimates, unless a binding delivery date is expressly stated.

ZP8 will do everything reasonably possible to meet the communicated deadlines.

The Customer is responsible for the accuracy and completeness of the delivery address provided.

In case of a visibly damaged package upon delivery, we recommend accepting it with reservations, when possible, and promptly contacting ZP8 customer service, attaching photographs of the packaging and the product.

9. Right of withdrawal

The Customer acting as a consumer has the right to withdraw from the purchase, without needing to provide any reason, within 14 days from the day on which the Customer, or a third party designated by them other than the carrier, acquires physical possession of the products.

To exercise the right of withdrawal, the Customer must clearly communicate their decision to:

• first name and surname;
• order number;
• product or products they intend to return.

The Customer may also use the withdrawal function made available directly on the website.

10. Return of products

After communicating withdrawal, the Customer must return the product without undue delay and in any case within the terms provided by applicable law.

Unless otherwise indicated by ZP8, the direct costs of return shipping are borne by the Customer.

The product must be returned with care and adequately protected for transport.

The Customer may examine and test the product to the extent reasonably necessary to verify its nature, characteristics, and functioning.

The Customer is liable for any diminished value resulting from handling the product other than what is necessary to establish its nature, characteristics and functioning.

11. Packaging, samples and sealed products

Some ZP8 purchases may be presented within a packaging experience that includes, in addition to the main product, samples or complementary products.

Opening the external packaging, when necessary to view the purchased product, does not in itself entail the loss of the right of withdrawal provided for by law.

For any sealed products which, for reasons of health protection or hygiene, are not suitable for return once opened, the exclusion from the right of withdrawal provided for by current legislation may apply.

Therefore, any cosmetics or other products subject to specific hygienic conditions must be returned intact and, where present, with their seal unbroken, in cases where this is required by applicable law.

12. Customized products

Except in cases provided for by law, the right of withdrawal does not apply to products made to the Customer's specific request or clearly personalized.

Any exclusion will be clearly indicated to the Customer before the purchase of the personalized product.

13. Refund

In case of valid exercise of the right of withdrawal, ZP8 will refund the payments received for the returned products and, where provided by applicable law, the cost of standard delivery.

Any additional costs resulting from the Customer's choice of a delivery method more expensive than the standard delivery offered by ZP8 will not be refunded.

The refund will be made using, where possible, the same payment method used for the purchase.

ZP8 may withhold the refund until it has received the returned products or until the Customer has supplied evidence of having sent back the goods, whichever is the earliest, in cases permitted by law.

14. Defective or non-compliant products

Products sold to consumers are covered by the legal guarantee of conformity provided for by applicable law.

In case of a defective, damaged, or non-compliant product, the Customer is invited to contact:

indicating the order number and attaching, when possible, photographs that allow the problem to be identified.

All rights recognized to the consumer by applicable law regarding legal guarantee remain unaffected.

The legal guarantee does not cover damages resulting, for example, from improper use, accidents, impacts, falls, failure to observe usage and maintenance instructions, or normal wear and tear of the product, when such circumstances do not depend on an original defect of conformity.

15. Craftsmanship and production characteristics

Some ZP8 products may have slight variations in color, surface, texture, or finish due to the characteristics of the materials and production processes used.

These characteristics contribute to the product's identity and do not automatically constitute a defect of conformity, provided they do not compromise its functionality, safety, or essential declared characteristics.

16. Eyewear Care

To preserve the characteristics of the eyewear over time, we recommend:

• storing it in its case when not in use;
• avoiding prolonged exposure to high temperatures;
• avoiding direct contact with aggressive chemical substances;
• cleaning the frame and lenses with suitable products and materials;
• avoiding inappropriate modifications or interventions on the frame.

Any specific instructions provided with the product must be followed.

17. Limitation of liability

Nothing in these Conditions limits or excludes liability that cannot be excluded or limited under applicable law.

ZP8 cannot be held responsible for disruptions or delays resulting from events beyond its reasonable control, without prejudice to what is mandatorily provided for consumer protection.

18. Intellectual property

The zp8.it website and its contents, including by way of example trademarks, names, logos, photographs, images, texts, designs, graphics, videos, and creative content, are protected by applicable intellectual property law.

Reproduction, distribution, modification, or commercial use of the contents without prior authorization from the respective rights holder is prohibited.

19. Personal data

Personal data collected through the website is processed as indicated in the Privacy Policy available on zp8.it.

The use of cookies and similar technologies is governed by the relevant Cookie Policy.

20. Applicable law

These Conditions are governed by Italian law.

If the Customer is a consumer residing in another country, their mandatory rights recognized by the applicable law in their country of residence remain unaffected.

21. Disputes and competent court

For any dispute relating to the interpretation, execution, or validity of these Conditions, the consumer may contact the competent judicial authority as provided for by the applicable consumer protection law.

Any alternative dispute resolution procedures may be used in the cases and according to the methods provided for by current legislation.
